The EB-5 green card visa program is an attractive option for many people outside the U.S. because it allows foreign investors and their immediate families to enjoy residency benefits in the United States, permanent green cards, an option to pursue citizenship after five years of legal residence, and more.

EB-5 Visa Program Basics

In order to obtain conditional permanent residence (green card status) for themselves and their immediate family members, foreign investors must invest at least $1 million in a commercial enterprise expected to create at least ten full-time jobs in the U.S. The minimum investment amount is lowered to $500,000 in rural areas or geographic areas with low employment.

When the visa application is initially approved, the investor receives a green card valid for two years. Three months before the green card is set to expire, the investor can petition the court to remove the conditions on the green card. At that time, the investor must demonstrate that his or her original investment has fulfilled the requirements of the EB-5 visa program, including that the full required amount was actually invested and in turn created at least ten full-time U.S. jobs.
